Gómez-Pinzón Abogados, through its technology, communications and data protection practice group, is able to accompany you in the process of participation and implementation of projects in the CRC regulatory Sandbox. The participation of those interested suppliers must exhaust the following phases:
1) Application Phase: Those who meet the required requirements may submit proposals to the CRC. During this phase, proponents will be able to correct requirements and make comments.
2) Evaluation Phase: As evaluation and qualification criteria, the coherence of the project, the proponent’s argument and the supports of their proposal will be mainly reviewed.
2.1 The proposal will be evaluated under the following criteria:
- Innovation versus the offer available in the market: Is it the latest technology? Is it a new way of using technology? Is it a different commercial offer than what exists in the market?
- Offering benefits for citizens: Does it comply with the provisions of the ICT legal framework and the PND (National Development Plan)? Does it offer access in rural or remote areas (targeted municipalities)? Does it incentivize competition? Can it have a positive effect on the price or quality of communication services?
- Impossibility of implementation under current regulation: Would it conform to current regulation? Is a high investment required to adjust to current regulation? Does it damage infrastructure, operators, networks or services of PRST, PCA or OSP?
- Ability of the proponent to effectively implement the project: Does it have previous experience in similar projects and the resources to advance the project?
2.2 The project must meet the following requirements:
- Analysis of the risks of the project.
- Safeguards to protect users.
- Indicators to measure your results.
- Have an Exit Plan and an Information Collection Protocol.
- Be authorized and appropriate as required by the CRC.
3) Experimentation Phase: Products, services or solutions may be marketed or used by suppliers for a period of 12 months that may be extended once for up to 12 additional months of be relevant.
4) Exit Phase: At the end of the project, if the suppliers wish to continue with the commercialization or use of the products, they must make the adjustments to comply with the current regulatory framework. span >
