On May 11th, 2020, the Superintendence of Industry and Commerce (“SIC” or the “Authority”) issued Resolution No. 20476, 2020 by means of which the merger control proceeding in Colombia is restarted. The foregoing, considering that pursuant to resolutions No. 12169 and 16978 dated March 31st and April 15th, 2020, respectively, the merger control proceeding was suspended for all such integrations that met the legal thresholds contained in the antitrust framework and activated the duty to inform, after the issuance of such resolutions.

Due to the foregoing, the SIC has enabled an e-mail that allows the Authority, the parties to a transaction and other third-parties, either: (i) to submit a short-form filing, (ii) to request for the approval of a transaction that requires the review and clearance from the Authority within a long-form filing proceeding, and/or (iii) to file responses to requests for information submitted by the SIC to such third-parties that are deemed as relevant for the proceeding to be carried out, in order to collect sufficient information in relation to the relevant market affected by an intended transaction.

Finally, it must be pointed that no further changes were provided, nor any modifications to the regular proceeding nor to the corresponding terms for each type of filing. Due to the aforementioned, the SIC will restart its duties in regard to the matter from May 12th, 2020.
