Defense for Jafer Enterprises in an unauthorized domain registration

Jafer Enterprises R&D, S.L.U (Jafer) as the owner of the Yanbal brand, and with the assistance of Gómez-Pinzón, filed and successfully completed an arbitration proceedings against “Domains by Proxy LLC”, “Asl Model” and “Mundo Web – Desarrollo e Innovación SAS”, over the unauthorized registration of the yanbal.online domain. These proceedings were held at the WIPO Arbitration and Mediation Center. The presiding arbitrator determined that considering the identity of the domain and the Yanbal brand, this became misleading vis-à-vis the domain’s corporate origin and the products and services that were offered on said domain. The arbitrator also decided that it had been done in bad faith since its owner was demanding from the domain’s legitimate owner (Jafer) a monetary compensation to return the property.
