The Technology, Communications & amp; Data Protection of Gómez-Pinzón Abogados informs you that the Communications Regulation Commission (CRC) has made public the following regulatory developments in the ICT sector :

1. Two circulars were issued with guidelines to providers of telecommunications networks and services (PRST) for the deployment of telecommunications infrastructure and in terms of access relationships with owners of electrical infrastructure:

1.1. Circular 130 of 2020 : By means of which the CRC reminds the PRSTs of the provisions of article 2 of Resolution 5890 of 2020 in relation to:

  • The modification of the agreements for the use of electrical energy infrastructure that, as of the effective date of said resolution, would contemplate remuneration conditions for the use of electrical infrastructure that were higher than the regulatory ceilings of Article 4.11.2.1. of Resolution CRC 5050 of 2016, which must be reduced to these limits.
  • The obligation of the PRSTs to report all their agreements on the use of electric power infrastructure that are in progress at the entry of resolution 5890 of 2020, no later than December 31, 2020.

1.2. Circular 131 of 2020 : Through which the Code of Good Practices for the deployment of telecommunications networks.

This document constitutes a technical consultation guide for local authorities, PRST and other interested parties on the basic aspects of deployment of telecommunications network infrastructure and the appropriate conditions for it, so that better conditions for an organized deployment can be promoted.

2. The CRC is carrying out a public consultation process with a view to simplifying the disused rules on television and content. The deadline for those interested to submit their comments is until October 23, 2020.

For the purposes of consultation by the CRC, by disuse should be understood that rule that must be eliminated from the current agreements or resolutions issued by the CNTV and the ANTV because it is currently not applicable. The foregoing, based on any of the following factors: (i) market evolution; (ii) technological evolution; (iii) regulatory duplication or (iv) transitory regulations.
