The Ministry of Mines and Energy (“MME”), through Decree 328 of 2020, defined the conditions that must be met to carry out Integral Research Pilot Projects (“PPII”), observing the provisions of the Contentious Chamber of the Council of State in Writ of September 17 of 2019.

For the above effects, companies interested in developing PPII must submit a request to the National Hydrocarbons Agency (“ANH”) and the ANH, in turn, must define the contractual mechanisms to do so. Likewise, the MME and the Ministry of Environment and Sustainable Development respectively must define the technical guidelines and terms of reference to carry out the activity.

The PPII will be developed in the following three stages:

(i) previous conditions; this stage will begin with the issuance of the Decree and will have the necessary term until the PPII project obtains its respective environmental license. Its purpose is to diagnose social, environmental, technical and institutional conditions for the development of PPII, prior to the drilling of wells.

(ii) concomitant; this stage will begin with the granting of the environmental license and will be extended until the completion of activities contained in the PPII. The purpose is to develop activities related to drilling, completion, fracturing, stimulation, and appraisal of the reservoir; and simultaneously, review, manage and monitor technical, environmental, health, social and institutional aspects.

(iii) evaluation; this stage begins with the termination of the activities contained in the PPII and ends with the publication of the evaluation results. Its purpose is to evaluate: (i) the information generated and the institutional strengthening needs; and (ii) the results of the PPII projects in order to determine if the conditions that permit the commercial exploration in Non-Conventional Deposits are fulfilled by means of the Multistage Fracturing technique with Horizontal Drilling. At this stage, the results of the evaluation prepared by the Evaluation Committee will also be published.

The Evaluation Committee will be formed by:

  • The Minister of Finance and Public Credit or his delegate;
  • The Minister of Health and Social Protection or his delegate;
  • The Minister of Mines and Energy or his delegate;
  • The Minister of Environment and Sustainable Development or his delegate;
  • An expert representative on environmental matters associated with an accredited university;
  • An expert representative on hydrocarbon matters associated to an accredited university; and
  • A representative of national associations, corporations, and civil society organizations.
