External Circular Letter No. 022 of the Ministry of Labor
External Circular Letter No. 022 of the Ministry of Labor clarified the competence to declare the existence of force majeure corresponding to the President of the Republic, who will base his decision on the analysis of the facts and particular context. Also, this Circular invites the Companies to opt for work-at-home, telework, flexible working hours, accrued, early and collective vacations, paid leave, and non-service payments to handle the need for isolation, on behalf of the health and social emergency caused by COVID-19. Finally, the Ministry informed the adoption of the figure of Rigorous Labor Inspection, through which the inspection, oversight, and control of the measures related to labor contracts within the health and social emergency, are reinforced.
